EARTHING FOR ELECTRICAL SYSTEMS
The D.P.R. No. 462/01, which entered into force pursuant to law on to law on on 23/01/2002, establishes an obligation for the employer to periodically check the company's grounding systems. Legislative Decree 81/08 where art. 87 reaffirms this obligation.
The checks, scheduled with a period of two or five years, concern:
1) the electrical and earthing systems;
2) systems protecting against atmospheric discharges;
3) plants installed in places at risk of explosion.
Please note that this fulfillment is a burden on the employer, not on the owner of the property / site where the work is carried out.
To date, the subjects authorized to carry out periodic checks are the bodies authorized by the Ministry of Economic Development and the local ASLs and ARPAs. The C.M.L. Vesuvio S.r.l. in collaboration with qualified bodies, it offers you the verification service pursuant to the aforementioned Presidential Decree 462/2001.

In case of non-compliance with the legal obligations provided for by the Presidential Decree 462/01, the employer or legal representative is criminally and civilly liable for the failure to carry out the verification envisaged, in the event of an accident attributable to this failure.
Furthermore, art. 87 of Legislative Decree no. 81/08 punishes the employer for failing to carry out the periodic checks required by law by Presidential Decree 462/01 and for the lack of reports on the control of electrical systems and protection against atmospheric discharges (administrative penalty from 750 to 2500 euros).
Still the employer is sanctioned by art. 68 if the plants are not subject to regular maintenance (shutdown from three to six months or with a fine from 2,000 to 10,000 euros, paragraph 1 point b) for the application methods, the procedures provided for by Legislative Decree no. 758/94.
